It is safe if you get them from legitimate site and services, generally, but not always.
A legitimate service or site will want to make sure their offerings are clean and safe.
Pirate sites, on the other hand, have no positive reputation with the industry or authorities, and what is submitted to them is submitted by just anywone, which could spike the software with trojans or virii.

Well the problem with itunes is that the music files are protected. So there is huge restrictions on it. However, downloading off a site may be risky depending on the site. But if you know the site and it has good reputation then download it from there because that way the files are not protected. Also, even if somehow you get caught pirating they really don't care too much. The fines are more for intimidation then actual punishment. They more try to shut down the sites then punish the millions of users who pirate.
